The Council has legal powers to act if work is carried out without planning permission or conditions attached to a planning consent are not complied with. The Council may serve an enforcement notice or other legal notice requiring the works to be remedied. There is a right of appeal against an enforcement notice, similar to the appeal procedure against refusal of planning permission.

The Council is seeking to ensure that in undertaking its regulatory and enforcement role it will be fair, open and consistent in its approach.
