Same sex marriages

In March 2014 the law changed allowing same sex couples to enter into a marriage or civil partnership (How to get married).

What is a civil partnership and who is it for?

A civil partnership can be formed between two people of the same sex.

They must:

  • Both be over 18 years old, or over 16 years old with parental consent
  • Not already be married or in partnership
  • Not be related to each other in a way which would prohibit the partnership being formed.

In a civil partnership ceremony, couples must acknowledge the legal words of the contract and sign the partnership schedule in front of an authorised person (e.g. Registrar) and 2 witnesses.

A ceremony is not required but couples can make the legal process part of a ceremony.

Give notice

To have a civil partnership you must give notice.

  • Book an appointment to give notice at the Oldham Register Office
  • Must be given 29 days before the civil partnership
  • Can be given up to 12 months in advance
  • Fee: £35.00

Civil Partnership Conversions

From the 10 December 2014 couples who have previously entered into a civil partnership can apply for a conversion to a same sex marriage.

This is an administrative process but couples can choose to add a ceremony if they wish.

A civil partnership conversion can be booked at any register office regardless of where a couple live or where the civil partnership originally took place.

Evidence of name age, address and a civil partnership certificate will be required at the appointment.

You can complete the process in one appointment providing both parties attend with the correct documents or you can choose to provide the documentation at one venue and sign the declaration at another venue or on a different date if you wish to have a ceremony as well as the legal process.

There will be no cost for coupes who entered into their civil partnership prior to the 29 March 2014 for the administrative process itself, (there will be a separate fee for the ceremony),for couples who contracted their civil partnerships after this date  there will be a £45 fee.

Fees

Fees must be paid at least 2 weeks before the marriage.

Fees payable to Oldham Registrars Office:

  • Notice fee: £35.00 per person
  • If a registrar is required to attend the civil partnership (Monday - Saturday): £350.00 (including certificate)
  • If a registrar is required to attend the civil partnership (Sundays and Bank Holidays): £405.00 (including certificate)
