Officers investigating allegations of noise nuisance need to gather as much detail about the alleged nuisance as possible in order to establish if a Statutory Nuisance as defined in the Environmental Protection Act 1990 exists.
If the alleged nuisance occurs during the working day, the officer will try to witness the nuisance in person. If the nuisance occurs during evenings, during the night or at weekends, the Pollution Control team have sophisticated noise monitoring equipment available to them, which can be installed into the clients home to record any occurrences of the alleged nuisance.
Once it has been established that a Statutory Noise Nuisance exists the Officer in charge of the investigation will initially try to resolve the problem informally by providing information and assistance where relevant.
However, if this is unsuccessful, formal action may be taken which could result in confiscation of noise making equipment (such as stereos) and/or legal proceedings being taken against the person/company causing the nuisance. This could result in a fine of up to £20 000.
